SMALL CLAIMS - FIXED FEE

 
1. Starting things off  

 

We will review your claim, have a brief discussion with you about our opinion of its merits, ensure that you have the correct paperwork in place, and help you start your claim off.  

 

Sometimes, a formal warning letter from a professional law firm (known as a "letter before action") is all that is needed to resolve the situation without things escalating.   

 

Where this warning doesn't work, we will file the papers for you and make sure that your case is ready to go forward.   

 

2.  Preparation of documents and representation  

 

What if the debtor receives your warning letter, and yet still doesn't pay ?  

 

W10 will be with your each step of the way; we can guide you if you need to escalate matters, and initiate the court proceedings that will help you to get your money back or to enforce your rights.  W10 will help you review your documentations, witness statements and other evidence, and can arrange for you to be represented at the hearing.  

 

We can handle the preparation of court papers (cases being initiated by a "claim form" document), and ensure that these papers are filed and administered correctly.   

 

This can also be done as part of our fixed fee service, and by using W10 this ensures that a firm, no-nonsense message is sent on your behalf.   

 

Please note that starting any court action requires additional fees payable to the court itself. W10 charges no commission on these additional fees, takes no part of them. These court fees are payable whether you use a law firm, or whether you go to court on your own.   

 

3.  Enforcement  

 

Once you have won your case in court, W10 are experts in the processes needed to collect the money that you have been awarded. In some cases we can even provide advice on locating assets and funds, if the debtor is trying to hide them. Once more on a fixed fee, we can handle all aspects of the "enforcement actions" and recovery of your money.   

 

Depending on the circumstances of the debtor, once the judgment is entered, and they face the prospect of having a "CCJ County Court Judgment" against them, we often find that they are a lot more willing to make payments.    

 

Otherwise, we can discuss whether action against their assets, including their bank accounts, is the right path for you.

 

Please note, disbursements including court fees, are not included in any arrangments.
