W10 offer a simple, no-frills fixed fee-service for your debt recovery helping you control costs and get your money back.
1. Warning Letter
Sometimes, a formal warning from a professional law firm is all that is needed to make your debtor see sense.
In accordance with debt recovery law, you must send a specific form of warning letter, known as a "letter before action" as the first step before taking any legal action against a non-paying debtor.
This will include information as to how much is owed, why, and to whom, as well as crucially when the money is expected.
W10's fixed fee scale makes things easy, with a fixed fee of £5.00 (plus VAT), and other legal options clearly and affordably spelled out, the uncertainty and the risk of enforcing your rights are minimised. Also, with our flexible "no win no fee" model for litigation, larger and more complex cases can be handled simply, and in many cases without cost to you at all.
2. Escalation and Court
What if the debtor receives your warning letter, and yet still doesn't pay ?
W10 will be with your each step of the way; we can guide you if you need to escalate matters, and initiate the court proceedings that will help you to get your money back.
We can handle the preparation of court papers (cases being initiated by a "claim form"), and ensure that these papers are filed and administered correctly.
This is done again using our fixed fee scale, and by using W10 this ensures that a firm, no-nonsense message is sent to your debtor.
Please note that starting any court action requires additional fees payable to the court itself. W10 charges no commission on these additional fees, takes no benefit from them, and these are payable whether you use a law firm, or whether you file court proceedings yourself.
3. Enforcement
Once you have won your case in court, W10 are experienced in collecting the money that you have been awarded. We can help to enter judgement, and in some cases even provide advice on locating assets and funds, if the debtor is trying to conceal them. If you have chosen a fixed fee option, we can handle all aspects of the enforcement and recovery of your money.
Depending on circumstances of the debtor, once a judgment is entered and they face the prospect of having a County Court Judgment (CCJ) entered against them, we often find that they are a lot more willing to make payments.
Otherwise, we can discuss whether action against their assets, including their bank accounts is the right path for you.
Fixed Fee or No Win No Fee?
If the matter is a straight forward debt recovery and the debtor is unlikely to dispute or to defend the debt, then we recommend you consider our fixed fee service. Is the matter more complex? Will the debtor argue over the amount, or that anything is owed in the first place? In that case, if your case is eligible then we recommend that you consider our "no win no fee" arrangement
